List of Specialist Regulatory Advocates – Bar Council representative to sit as an independent member of the Regulatory List Appeals Panel (one position)

TERM: 1-year term (commencing late 2024)

The Bar Council is looking to nominate one Barrister to sit on the Regulatory List Appeals Panel.  The Panel will determine appeals against the Regulatory List Management Board’s refusal to appoint an advocate to the Regulatory List.  These are paper exercises (i.e., no interviews) that will entail considering the original application afresh and meeting with other Panel members (virtually).  Successful appeals will result in advocates’ appointment to the Regulatory List.

About the Selection Board Process

It is anticipated that one Panel will determine all appeals.  Panels will be held virtually via MS Teams.  The Panel is made up of the Chair (who will be a Senior Lawyer drawn from one of the participating Regulators), another Senior Government Lawyer and the Bar Council Representative.

About the role of the Bar Council Representative

The Bar Council Representative’s role is to actively participate in the decision making process and will require assessment and scoring of applications independently in advance of a meeting of the full Panel.

The aim will be for the Panel to determine all appeals in one day on a date to be confirmed.  However, dependent on the number of appeals received, a further date(s) may be necessary.  The Bar Council Representative will be required to attend virtually between 9am to 5pm, most likely in January 2025. The Bar Council Representative will also attend a pre-briefing meeting with the Chair and receive the application forms and associated documents prior to the Panel meeting.

Knowledge and experience

Applicants for the Bar Representative role should be King’s Counsel (the Regulatory List is restricted to junior Barristers).  We would particularly welcome applications from Barristers who have previously been members of the Regulatory List but have gone on to take silk.

Applications will be presented to the General Management Committee of the Bar Council who are responsible for selecting the successful candidate based on merit.
